The terms and conditions below shall be deemed to be included in the contract between NES and the UK customer. They apply only to UK customers (excluding Channel Islands and BFPO’s)
Description of products
NES strives to make sure that the descriptions and pictures within the catalogue are as accurate and informative as possible (errors & omissions excepted). In order to improve the quality of the goods and services we reserve the right to change specifications or improve our products. If you find any substituted product is not suitable we will issue a full credit, as long as the item(s) in question are returned in a new re-saleable condition. See return of goods section below for procedures on how goods should be returned. If the original transportation packaging is not available, please return the item(s) suitably packaged to ensure the item(s) is not damaged.
Prices
(i) Prices in this catalogue will remain fixed until 31st December 2010 unless circumstances beyond our control dictate otherwise. The prices quoted supersede all previous prices. Prices are subject to change without prior notice and those charged will be price effective at the order receipt date. Prices are strictly net.
(ii) All Price Reductions refer to the entire NES 2010 range when compared to 2009 prices
Value Added Tax
All prices shown exclude VAT. VAT will be charged at the appropriate rate on all applicable products and shown on the invoice. (NB. Education Authorities will credit LEA schools with the tax paid on receipt of the appropriate forms.)
Product availability
Goods contained in this catalogue are offered subject to availability. If an item ordered is out of stock we will advise you of the action we have taken and endeavour to supply the items as soon as possible. On occasion goods will be discontinued for reasons beyond our control. We reserve the right to withdraw any items where a printing error has occurred.
Payment
Unless otherwise agreed payment is due within 30 days of invoice. Payment should be made to Accounts Department, NES and sent to NES, Gregory Street, Hyde, Cheshire, England SK14 4SG. You may make your invoices either by cheque, credit card or by BACS. If you wish to pay by BACS please contact our Accounts Department for the relevant bank account details.
NES reserve the right to charge interest at 8% above Bank of England base rate on all overdue amounts and the customer will be liable for all legal costs.
New Customers and Non Account Holders
To open a 30 day FREE Credit Account please contact our Contact Centre Team for more details. We may consult a credit reference agency. Alternatively, goods can be supplied on a cash with order basis against Credit Cards or Cheque.
Passing of property
The risk in the goods supplied shall pass to the buyer on delivery into the buyer’s possession or to the carrier or place of delivery nominated by the buyer and the seller shall be under no obligation whatsoever for any loss/damage occurring thereafter.
Title of Goods
NES retains full title to goods until paid for in full. In the event of insolvency, NES reserves the right to reclaim goods for which payment has not been made.
Packaging and Delivery (UK Mainland)
Each order of £300 or more (exc VAT) will qualify for FREE Delivery. Orders that are under £300 (exc VAT) will attract a small carriage charge of £4.95.
A small order handling charge of £2 will be added to orders under the value of £50 (exc VAT)
Certain items of furniture and larger items may require a personal delivery, in this instance a £10 delivery charge will apply.
Express Delivery
If you require Express Delivery (UK Mainland Only) please call 0845 120 4525 before 11am. If your order is in stock we will despatch the item the same day by a 24 hour delivery service. This service costs an additional £9.95 (+VAT), irrespective of order value. We regret that furniture, large items and direct supply items cannot be despatched by Express Service.
Direct Despatch / Made to Order
Certain items come directly from the manufacturer and may take longer to despatch. Some items are also manufactured at the point of order and can take 4 – 6 weeks for delivery. Such items are identified throughout the catalogue.
Standard Delivery
For orders placed before 4pm Monday to Friday, NES will deliver your item(s) within 2-4 working days, most often on the third day. This delivery time is only available on items in stock and excludes direct delivery items. Items requiring 2-man deliveries may take longer.
NES will try to meet specified delivery dates however accepts no responsibility for any loss, damage or expense from the late delivery of goods by itself, its agents or its agent’s carriers. Delivery time/ date or date of despatch which may be specified are a best estimate only and should not be relied upon.
Please note that for furniture and other large item, the cost of delivery is to the ground floor only. An additional charge may be requested by direct suppliers for deliveries within a specified time frame e.g. 9am – 1pm. For particular delivery requirements please enquire at the time of placing your order.
Packaging Removal
Where furniture items feature the packaging removal icon, NES will remove all packaging waste on delivery.
Proof of delivery
For a period of 90 days from the date on the invoice a signed proof of delivery document will be available from NES. After this period, NES may decline to provide proof of delivery or make a charge to supply it. After this time the buyer will be responsible for payment of the goods supplied.
Delivery discrepancies
Please check all parcels at the time of delivery and if you find goods are damaged, incomplete, incorrect or short delivered, you must notify us within 5 working days of delivery. For non-delivery of goods notification should be made within 7 days of the invoice date. Any claims outside these time frames will not be accepted. Please do not attempt to return any goods without prior authorisation and you must quote your account number and relevant reference number.
Deliveries Refused
For all consignments refused without reason we reserve the right to make a carriage charge plus a 20% handling charge, or minimum of £10 whichever is greater.
Returning Goods
NES product guarantee relates to the quality, durability and relative fitness for purpose during the first twelve months after delivery. Any products returned will be assessed by our Quality Control department before any compensation is given. If we find no fault we will not provide compensation and reserve the right to charge a 20% handling fee or minimum of £10 whichever is greater and recover any delivery charges incurred. If an item is faulty, we reserve the right to repair or replace. If it is not possible, a credit will be issued Goods no longer required, due to ordering error/surplus to requirements, may be considered for return if prior authorisation is obtained and notification should be within 5 days of delivery. Where authorisation is obtained a 20% handling charge or minimum of £10 whichever is greater will be charged. Please note customers will be charged the full cost of the goods plus the above fee and any delivery fees incurred for any goods not returned in a re-saleable condition and in the original packaging. Unfortunately self-assembly items can not be returned if they have been assembled. In some instances, such as special orders or direct delivery, it may not be possible to return goods and the seller will invoice the full amount.
Force Majeure
NES shall not be liable to the buyer for failure to perform or delay in any of their contractual obligations when this is caused by situations beyond their reasonable control.
Recording Calls
To improve the service offered and for training purposes some calls may be recorded.
Data Protection
NES is a registered data user under the Data Protection Act. We never make your personal details available to other companies for marketing purposes other than for the marketing of NES goods and services. We (and our parent company) may hold your personal details in order to process your order and/or maintain your account. We (and our parent company) may also use your details to send you further information on NES goods and services, to keep you up to date on goods, services, new products and promotional offers you may be interested in or for research purposes. WASTE FROM ELECTRICAL AND ELECTRONIC EQUIPMENT - WEEE DIRECTIVE
The United Kingdom is under an obligation to minimise the disposal of Waste Electrical and Electronic Equipment (WEEE) in domestic waste, and to encourage recycling, recovery and environmentally sound disposal methods, NES is committed to promoting the re-use, recycling and recovery of WEEE products by contributing to the VALPAK compliance scheme. WEEE Products or Packaging will be marked with a crossed out wheelie bin symbol (see below) to indicate that the product should not be disposed of in general domestic waste but disposed of through an approved WEEE scheme. NES 10 year guarantee
Certain NES furniture items have an extended 10 year guarantee. These are indicated by the 10 year logo and it applies to functional furniture. It specifically relates to the quality of the wood, hinges and lock, and excludes ancillary items such as trays and moving parts (castors). Please note that the same items from previous years may not have been covered by the guarantee at that time.
